Contentious Wills, Trusts and Probate
Recent years have seen a huge increase in disputes involving challenges to the provisions of a will and claims against a deceased person’s estate. The causes are various: an ageing population, increasingly complex family relationships, and greater personal wealth amongst others.
We provide a comprehensive service to persons who become involved in disputes of this nature. We have broad experience of advising personal representatives in claims against the estate, and for beneficiaries who wish to challenge the validity of a will or consider that they have otherwise been unfairly provided for. As well as representing individual personal representatives and beneficiaries, we advise estates, trustees and charities.
We aim to resolve disputes through a non-adversarial approach with the involvement of the court as a last resort. We work closely with you to ensure careful consideration of the legal issues and a practical solution of the problems faced.
We understand that this is a sensitive and difficult time and, therefore, take pride in offering a service that is friendly, approachable, as well as professional.
If you wish to challenge the validity of a will, or make a claim against an estate, or if you are facing a trust or fiduciary dispute, it is essential that you seek our specialist expert advice sooner rather than later, as there are time limits which apply which restrict when these types of claims can be brought.
We are happy to consider free initial interview and insurance funded arrangements. In appropriate cases, we will also consider providing services on a conditional fee agreement (no-win, no-fee).
